intellify as a Data Processor

How does intellify process personal information in its role as a data processor?

intellify provides many different services to our Customers. Most of our services involve the processing of Customers' data, including their personal information. The goals of the processing are decided by our customers, not by intellify. This makes the Customer the Data Controller. In such cases, intellify acts as Data Processor and processes the data on behalf of and in accordance with instructions given by the Customer. The relationship between the Customer as Data Controller and intellify as a Data Processor must be regulated by a data processing agreement.

Customer and intellify obligations

When the Customer acts as Data Controller, the Customer must, in accordance with applicable data protection legislation, ensure the legal basis for the processing of personal information. The customer must also assess and establish ownership of the risks to which data subjects are exposed through the processing of their personal information. Another important aspect of the Customer's obligations as Data Controller is to comply with the information obligation in relation to data subjects.

intellify is a natural part of the Customer's obligations as Data Controller in the sense that intellify services form part of the processing of personal information that the Customer must ensure is in accordance with applicable data protection law. Thus, when intellify processes personal information on behalf of its Customers, we must do so in accordance with applicable data protection laws for Data Processors.

In short, the Customer and intellify are required to cooperate to ensure the privacy of data subjects. intellify provides the Customer with the necessary information so that the Customer can act in accordance with applicable data protection legislation.

Subcontractors and export of personal information

intellify uses subcontractors to process personal data and in this connection can export your or our Customer's data to a location outside the EU. These subcontractors are typically providers of cloud services or other IT hosting services.

By using subcontractors, intellify will enter into a Data Processing Agreement (DPA) with subcontractors to secure your personal data rights and to fulfill our obligations to our Customers. When subcontractors are located outside the EU, intellify secures the legal basis for such international transfers on behalf of you or our Customers, including by relying on Privacy Shield (US) or by using EU Model Clauses.

intellify relies on some strategic third parties that support our business processes and provide our cloud services. Further information on intellify's use of subcontractors is provided here.
